I Have Some Problems In I-140. Mine Is 3yrs Bach+1yr Diploma Degree, Professional Job As Analyst, Eb3 Category. I Am From From Maryland So Vsc Is Center. My Lawyer Called Me That File Is Ready To Go But Vsc, Tsc And Csc Are Not Excepting Any I-140 Now, They Has To Be File At Nsc. But Nsc Is Very Strict And They Are Denying For 3yrsbach Degree In Professional Job. So I Don't Know What To Do? Any Ideas? Any One Like Mine Case? Please Let Me Know.

I know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.
Short answer is NO.
You have to file a new PERM and it will be processed in the existing processing times unless its a special handling case (University profs, etc) which currently is taking around 4 months to get a PERM approval.

I agree with you that you need to go with lawyers who are really specialized in immigration especially when the case is complicated.
I know a person whos company lawyer screwed up the case. (They are from a very reputed law firm). Then she went with Murthy, they did a great job and got it done for her. They charged her a lot but it was worth it.
So get the best out there. It may be expensive but if it fixes your case its worth it.

Case Summary:
* Employer A = Previous Employer with whom I have my I-140 approved
* Employer B = Current Employer. I do not have a PERM or I-140 approved with this employer. I used my I-140 with Emp.A to get a 3 year extension when I transferred from Emp.A to Emp.B [So now, due to this extension, I have my H1-B approved upto Aug'08 instead of June 2006, which was the end of my H1-B six years]
* Employer C = Future Employer. I am planning to move from Emp.B and join this Employer now.

Hi ,
I attended H4 VIsa intervew recently at Chennai,India and got Green 221(G) asking for some documents from petitioner. Meanwhile my husband changed the employer and got new I797.
Now at the time of submitting the documents, I understand that I need to submit new I797. But what about the documents stated in 221(G), Do I still need to submit them? If so which petitioner's documents do I need to submit? Old one or new one? As the query was mainly about petitioner and now that the petitioner is changed , do I still need to submit them?
Please advice.

Whether it is Department of Homeland Security (DHS) policy or not, I do not know, but last week, I noticed DHS personnel roaming through the terminals at Dulles International Airport in Washington, DC. They actually went to various gates and randomly requested ID or passports from OUTBOUND passengers seated in the boarding areas.
That is, they checked the documents of both Americans and foreigners who were LEAVING the USA. Not entering.
I followed them around a little bit. The officers were friendly, civil. They approached passengers in the terminal, asked them their final destinations, and asked if they could see their passports. Interestingly, although I was standing right next to a bank of chairs in the boarding area, they did not ask me for my passport, nor did they ask anyone who was standing or walking through the terminal. They only approached persons seated in the departure gate area. I did not see them detain anyone.
I have often been asked whether DHS personnel made random checks of persons in airports. I used to say that "they could, but I've never seen it." Well, I have now. --jcf

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. I have recently got married and entered US on AP, I have not used my EAD and started working for the same employer (GC sponsered). My wife is going for H4 Stamping in US consulate in India. Does any one has any experience? Do you see any problem during Stamping.

I suppose you are doing consular processing? Right? Well, when the consulate is aware that your PD is about to be current, and if all other tasks are completed, they should send you packet 60-90 days in advance of your interview.

Is postal address for e-Filed AP & EAD same, I have e-filed the EAD/AP renewal have 2 questions please respond.
1) The postal address for AP shows same as EAD renewal for e-Filed, is this correct.
2) The 2 photos is only for EAD renewal not AP, seems they will take a picture/fingerprint for AP by appointment.
Req docs, you will have to send (I-765/EAD)
1. a copy of of your I-765/EAD E-file receipt,
2. pending I-485 receipt,
3. two 2"x2" passport photograph,
4. copy of your previous EAD, both side
5. drivers license, both side
6. passport non-immigrant visa page
(even if its expired, it will serve as a federal issued photo ID).
Req docs, you will have to send (I-131/AP)
1. I-131/AP E-file receipt
2. Photo Id: License
3. Passport visa page
4. 485 receipt copy
If applying for Re-entry Permit, you must be fingerprinted as part of USCIS biometric services requirements. After you have filed this application, USCIS will notify you in writing of the time and location where you must go to be fingerprinted. If necessary, USCIS may also take your photograph and signature.
