I am on H1b and work for a desi consultancy company. My project with a client ended some time ago and due to bad market, I have been so far, unable to get onto another project. Now my employer is asking me to go back to my country for some time as I dont have a project in hand. I am worried that this may result in canceling of my H1b visa. However, employer is trying to assure me that he won't cancel it. I am wondering has anybody (somebody you know) been in this kind of situation. FWIW, I do have an american undergrad degree and have been living here legally and lawfully for past nine years.

Hearings will go on for a while. Since it is already known that the public oppose amnesty, personally I will definitely forget CIR. It may return again next year, but remember that by then the Senate may have voted out a number of incumbents that voted pro CIR.
I think this will take patience. If one can wait and watch this unfold for the next 2-5 years without going crazy, then you may watch the passage of CIR during your lifetime.

Recently my employer has decreased the hourly rate given for many years in the pay stub but providing the difference as bonus. Will it affect my EB2 Classification and I-485 approval.

Hi,
Need advice from an attorney:
My I-94 expires in december 2010. I have an approved Advance parole till Dec 2011(I485 is pending). Is it required to travel outside the country and get a new I-94 ?
2. Is there a source on the Net that I can refer to that explains this?

If you are maintaining H-1B status, you can file for status extension and will get new I-94.
If you are using EAD and have I-485 pending "status" then I-94 extension is not necessary.

Are there any rules that you need to leave a country during 30 days after your H1-B got approved. Almost all my friends needed but my lawyer said that I don't need to. I am confused what if he makes a mistake.

We have organized an Immigration Voice booth this Saturday August 18th at Pierce College, Woodland Hills at the IALA (India Independence) event. 14,000 people attended this event last year. Our aim is to talk to the general public about our issues, increase our membership and to generate publicity for the DC Rally. We will be handing out printed material, giving presentations and discussing our issues with the public.
The booth will be open from 3pm to 11pm. Come volunteer at the booth or visit us on the day. For more information on how you can volunteer, join the Southern California chapter here:

I donot think that these people are directly responsible for creating the issue in the first place....It is a reactive response to the anti-immigrant postures of many candidates...Also people like are us are not eligible to donate to immigrantList...Only citizens or premanant residents can contribute to immigrantList.....

Hello - I have a unique situation. I'm currently in the US on H1B, and my fiance is in India working for a reputed software company. We are planning to get married by end of April.
I want her to come to US on a work visa (hopefully H1B). I got to know that to make the FY09 H1B cap, she has to apply for H1B on Apr 1 2008, and wait till Oct 1 to travel if her visa gets approved. But since we are getting married by end of April, I don't want her to stay in India till October while I'm here.
The other option I was thinking was to apply for her H1B on Apr 1, but still go ahead and apply for H4 in early May, so that she can travel on H4 in May. And once her H1 is approved, she would already be in the US and can start working from Oct 1. Is this possible? Will this plan create any problems for her H4 or H1 visa application?
If the above does not work, what are my other options? If I miss the Apr 1 2008 deadline, the next earliest she can apply for H1 is Apr 1 2009, and work from Oct 1 2009 - and I don't want to wait that long.
Another option is to get married before Apr, get her to US on H4 before Apr, and apply for change of status to H1 on Apr 2008. But the marriage plans for Apr is made and to push the dates back would not be easy.
Any help in this matter is appreciated.

I am planning to use AC21 by joining a company on this March month end , I asked new company to process H1, and its in progress.
In APRIL Visa Billiton my PD is current, as I have PD of JUNE 2001( EB2), my RD - JUNE 29, 2007 .at this stage if I change company what is the impact on my GC approval. Should I wait for some more time to join the new company?

Applying AC21 will trigger the IO to update the case, and if all is fine, in some case, the case could be approved, though not at all time, You can try your luck, In July when all cases were current happened to a colleague with PD2004, the case was approved in a week after mailing AC21. Check with an Attorney.

Like Tom said, EAD is irrelevant to your studying on parolee status. The only thing is you cannot work during the EAD gap.

The pamphlet covers the visa process, important documents, workplace and employee rights, human trafficking, and how to file a complaint. This is a very useful document, not just for immigrants. Is Employer required, by law, for H-1B fling for qualified job applicant? My understanding is that it is upto the employer whether to file any visa sponsorship (including H-1B) for applicant. And its' employer's choice to put "No visa sponsorship" in the job advertisement.

your second one is much better.... a bit of advice on the first one: get that yellow thing out of there!!! You first one, is a bit unorganized, and well not really too interesting, no effects that grab your eyes. The second one, while very simplistic too at least has a much more pleasing layout. Keep at it - you're already improving.

Thanks for reading this message. Since you are from mid-west, you are capable of taking your car and drive in the direction of DC. It will take anywhere from 9-15hours. But you will be able to do it.
If there was a possibility of USCIS handing a GC in person, you would have driven 50 hours. Can you not drive for 10hours for a cause that is affecting you, me and everyone around us?
Now make up your mind and drive and meet other mid-westerners in DC.
I know one mr Gan*** - who flew to Nebraska with a Substitute labor and i 140 petition on the last day before labor substitution was banned. Mr Gane** also filed for 485 after the fiasco and we had a drink together because he thought he did a marvellous job as he is just 2 months old in US and has just landed in a consulting job and already applied 140/485 during the fiasco.
But he is not willing to hop onto my car, lives 5 miles from my place in Queens, to go to DC.
This shows the poor attitude people have towards grassroots efforts.
