Hi guys,
I hit a road block lately with my new H1B application. I'm on extended OPT and filed for my H1B in regular processing in the month of Sep'10 while working for a Client A. The Client A could not provide an Client letter during that time. My employer has then proceeded with a letter from my Prime Vendor . Then, unfortunately after 1 month of filing my H1B, my contract with Client A ended and I moved to another contract with Client B. Now, USCIS had few questions with Client A because of missing client letter and gave a RFE on my case. My employer then responded with an amendment petition to the RFE with the new Client B and also provided a client letter from Client B this time around. But, unfortunately USCIS has rejected the amendment petition and stated they are looking for Client A stuff as the primary H1B application has listed Client A and now, I just received an update that my H1B has been denied stating the same reason that USCIS is still looking for response to the query on primary client (Client A). I'm really struck now as my employer is in no mans land whether to file for a MTR or not, fearing that USCIS might not change the verdict because they might still look for Client A letter.
I need your valuble advice in this situation ASAP.

can you please let me know when is the USCIS fee increase is scheduled from?
Also, say for I-485 the fee is 1000, does this fee include for spouse also? Or For spouse, the fee is extra $1000 ie the fee is per applicant or per family

Why not microsoft? The rest of high tech industry will not survive if they can't move their 60% of operations outside of USA. Bone headed congress will continue to come up with legislation that encourage illegal immigration and discourage legal immigration. Sounds like 19th century for UK, 20th century for USA and 21st century for China and India. Dollar declines and what is the use of GC? I am thinking of going back where the growth is.

Question 1] Will this new H1B for Company B be valid for 3 more years (Till Feb 2011) or will this visa have to be renewed in November 2008 (remember by visa stamp for Company A is valid till Nov 2008)?
Generally you should get 3 years, if you have three years to get to the 6 year limit of H1B.
Question 2] What if I want to travel to India this October (remember by visa stamp for Company A is valid till Nov 2008)?? Can I still travel on my old visa stamp or will I need to go to embassy again in India for a new stamp
A Colleague of mine did this and did not have an issue. He went to india last Oct with his previous visa stamped in his passoort and I 797 approval of the new visa. My Company lawyers told him that he wont have any issues and he is back from his vacation and working. So i guess he did not have any issues.
What I dont know if how long was his previous visa valid for but I dont think it should matter till it is valid for sometime when you try to enter the country.

Keep Visiting IV
It is better to maintain ur F1-status (meaning all that needed to be on F1) atleast till you get receipt number.
(So that there is no need to worry incase ur application gets rejected and you dont get receipr number).
If you are on F1 while applying i-485, There is no clearly defined rules on when your F1 status goes out after aplying I-485.
If you are currently on valid F1 status then you can keep that status if you want to, provided if you obey all F1 rules
In general, If you use I-485 EAD and AP you are almost out of F1-status

A good friend of mine is getting divorced with her husband. The husband is the primary employment based green card applicant and their dates are current.
Will her I-485 be denied after the divorce?

Hi All, My question is similar to this question as asked by MSS (Do I need an AC21 filing?). But it's diff in few ways. Here are the details of my case:
I worked with my GC "sponser" (i.e. Ex-employer i.e. A) for exactly a year; then next employer for 4 months; then next employer for 15 months and now I am with my current employer (i.e. B) since 2006.
All this means is that in between I have changed TWO employers and currently with a 3rd employer for more than 2 years. Also it means even though my labor was filed while with employer "A" but I left them even before my labor was approved. I started working with my next employer (other than B) before my labor with A was approved, but my GC process continued with A.
fyi, I am calling my ex-employer who is sponser of GC application as "A" and my current employer as "B". In our discussions, I am not giving any name to in-between employers.
My GC dates have become current with A (It's a 2004, EB2 case).
I have not used my EAD yet with any of the employers and so does my wife. i.e. I am on H1B with current employer. Also I never filed AC21 for any of the employers.
140 approved for more than 5 months (but less than 180 days) and I-485 pending for more than 11 months.
Now here are few questions I have:
1. Do I need to file AC21 or not? and why?
2. How filing/not filing of AC21 can impact my citizenship?
3. Is my pending labor with B an issue for the dis/approval of AC21?
4. After getting GC with A how does it affect my employment/H1B with B?
5. What if I get the GC before I file the AC21?
6. Do you see any issues with portability, in general (keeping in mind that, I already left �A� and the GC is for future employment?)

I've been waiting since 20th of December. Thats when they (NSC) received my documentation reply.. and still no news!!! Have heard that NSC were on vacation (December and January), they just returned ... That's too bad!
