Since there is a mad rush of i485 applications , USCIS is going to do lottery to select applications for approval.Rest of them will be rejected.

Understood. However, my question is still is unanswered. My question was when can I apply for the new 3 year H1-B term
Scenario1: I can apply after 1 year anniversary of leaving H1 adding the 15 days spent in the US on B2 status ?
Scenario2: I can apply after the the 1 year anniversary of my last entry in the US which is obviously on B2 visa since I have entered a couple of times on B2 after leaving H1 ?
Question 2
A related question is how does the USCIS know my H1 cancellation date ? Do I ask my previous employer for it ? It cant be my last US paycheck date because my employer put money in my account a few months after I left H1 as well because of some payroll issue. The H1-B visa stamp was cancelled also few months after the actual leaving H1 date when I got my B2 stamp .

Can't avoid anything that future hold for you.
1. It would be good if the employer does not let USCIS know about your layoff.
2. don't apply for unemployment benifits even if you are given one (at least for 180 days from I-140 approval).
3. Hoping your employer does not revoke your I-140
4. Take a 3 months unpaid vacation at the same job and/or offer help by working from home. Accept a lower salary for 180 days.

I traveled (together with my family) through this route last year with the same circumstances you are in. There will be no problem and they won't ask you for any documents. If your flight on return is from Dubai to any US city, they will see your AP, Passport. If you have a valid AP at that time then they will allow you back.

I transferred my H1B from Company A to Company B. Currently i am working with Company B, but my Company -B's H1B Application is Still in Pending.
Now i would like to do the COS from Company B(pending H1B) to F1 as I already received I-20 from the University for the Spring 2010.
Case Description: Assume that, we applied Change of Status from H1B to F1 and it is in pending status.
Case i : what happens to my Pending H1B Application with the Company B.
Case ii : What happens if my H1B with Company B gets approved/Denied, when COS from H1B to F1 is pending.
Case iii: what happens if my H1B to F1 Change of Status gets denied.

So it looks like I have 2 independent questions:
1. Can an H1B be transferred to a new company once the H1B holder is in their 6+ year?
2. Can one port their EB3 case to EB2 with a new employer?
After reading around in forums, the answer for question 2 seems to be Yes and with some successful examples.
What is still not clear is questions one.
Any help please?

Here are the minutes and action items ---
1. Congressman/woman are to be focussed but Sen. Kennedy 's office is the most important to focus on.
2. AI: Call Sen.Kennedy's office and try to seek an appointment to explain our issues and make presentation. Aim for last week in January.
3. AI: Find out stance of congressman/woman from MA on immigration committee. If any of them are in immigration sub committee. Identify the counties which these lawmakers represent. This will be a good way to filter out the ones we do not have to concentrate on.
4. AI: Make a list of groceries and places frequently visited by immigrants who could become potential IV members.
5. AI: Refine the presentatioin on IV resources section and provide the first draft to rest of team for feedback - 2 weeks.
6. AI: To enquire about the cost involved in posting ad in India New England paper/media.(Cost can be shared among local state chapter members)
7. AI: To enquire about posting ad (one frame) in Belmont theatre where Indian movies are shown. (Cost can be shared among local state chapter members)
8. AI: All members: Publicity of IV using posters and flyers available in IV resource section. Also publicise on sites like immigrationportal.com etc.
Though action items are assigned to certain members, if there's a feeling that you can pitch in please do so.
Important updates from core member: CIR is on top of the list with Sen.Kennedy but the illegal issue is also going to catch up so we should initially push for CIR or Plan B would be to ask for our provisions to be included in a separate bill if CIR gets complicated and is time consuming.

Hello Friends,
I have utilized AC-21 and moved onto another employer and I will be using my EAD. I have an I-94, from the I-797 of my previous employer, which expires in May 2008.
The question I have is if we have utilized AC-21 can we still live here in US past the I-94 date? Will the stay be considered legal? I ask because as far as I know when a person is on H1B he can not afford to go past the I-94 validity date, does the same apply with an AOS applicant?

Secretary Janet Napolitano of the Department of Homeland Security (DHS) announced (http://www.aila.org/content/default.aspx?docid=32175) on June 3, 2010 that the U.S. and France have established an arrangement to implement the Immigration Advisory Program (IAP), which allows for the identification of high-risk travelers at foreign airports before they board aircraft bound for the U.S. This arrangement has been launched at Paris� Charles De Gaulle International Airport. A similar arrangement was entered into on July 1, 2009, implementing IAP at Madrid Barajas International Airport.
The purpose of the IAP is to allow specialized U.S. Customs and Border Protection (CBP) personnel posted in foreign airports to utilize current targeting and passenger analysis information and/or an assessment of passengers� documentation to identify high-risk persons bound for the U.S. and to make �no board� recommendations to carriers and host governments.
Secretary Napolitano believes that the IAP arrangements will enhance the capabilities of both the U.S. and foreign countries in which we have collaborated with to protect our immigration systems as well as the global aviation network from abuse by terrorists and transnational criminals.
DHS currently has IAP arrangements with seven (7) countries and operates at nine (9) locations.
