Hello all:
Applied for 140 transfer TSC June 2007. Have not heard anything since, I mean absolutely nothing. Is this due to the backlog?? I am starting to get worried as I checked my status and all it says is, the received date and that when there is update they will let us know.
Did any of you apply 140 transfer in TSC around that time? Any news on those? Any case that it could've been lost?
Big question to the experts is, what do I do to make sure they are working on it and my application is in queue.

What do you mean by transfer. You can not transfer I140, you can only port the PD.

What do you mean by transfer. You can not transfer I140, you can only port the PD.

Hello,
My original H1B visa was issued to me on Oct 1st, 2010 and is valid till Sep 30th 2010.
I got a new job in 2009 and they applied for my H1 transfer. It was approved and the new dates on the new I797 are 10/01/2009 till 09/17/2012. I went to India after that and when I returned, I got a new I-94 off course which was stamped to be valid until Sep 30th 2010.
Now I am nearing the end of my original H1B visa issued by my previous employer and stamped on my passport this coming October. I am also planning to go to India in this coming June. Will I will have to get my visa renewal stamping done this time if I go to India? Will I need a new H1B stamp on my passport from my new employer on my passport to come back?
I really appreciate any words of wisdom from all you learned people on this forum. Thanks in advance!

H1 extension can be applied upto 6 months before the expiry of current H1.
If you haven't completed 6 years on H1, you can always extend it as usual.
If you have completed 6 years on H1B, you have to have one of the following to extend your H1B.
1. Labor/Perm was applied at least 1 year back
In this case, your H1 will be extended another year
2. I-140 is approved.
In this case, your H1B will be extended 3 years.
More than likely your I-140 will be approved before November 2009 if it is a reasonably clean case. ( USCIS I-140 processing time has come down drastically)
BTW you don't get an H1 automatically on your 140 approval, your company has to apply for it.

I know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.

Doesn't the date fall on a Sunday? It is probably a system update: I belive that similar things have happened to others. Don't worry and enjoy your weekend.

Company A can not by law press any charges for the filing fees of H1B petition but they might go after you to pay for other costs in case you have agreed to pay for attorney fees.

Does your employer do all the work or the lawyer?
All H1 extensions are now processed in California (I think). So you should get the WAC number (EAC-Vermont,LIN-Nebraska,WAC-California,SRC-Texas). And my employer's lawyer sent the application end of may (31st I think) and we received a notice dated June 8th.

You can register a PACER Account through Federal Court Website, then you will be able to search for other WOM cases in your district.

I understand that after getting your 45day letter your case will be in the BEC database and will be processed in order.
Now I just saw people on this forum with PD Aug 2003 got approved 10/17.
and I know a friend with pd oct 2003 got approved in April.
Suppose that the guy got approved 10/17 was input to the system after the other luckier guy, the most conservative estimation is now pd Aug 2003 is being processed.
Anybody heard of any later PD being approved recently? from DBEC?
I'm just thinking, if we share the pd/approval information on this forum we'll have better estimates about our cases and have a somewhat less stressful life.

An H-1 petition filed by a new employer should have no direct impact on your AC-21 GC process. Because you are not currently in a valid non-immigrant status, you are not eligible for a change of status in the US. In any event, the petition would not be valid before 10/1/2010 assuming the employer is not cap exempt. So, you would have to travel out of the US to apply for the H-1 visa to be stamped in your passport. To be safe, you should make sure you have a valid AP with you before travelling just in case there is a problem ofr delay at the consul.

I am currently working for big consulting firm, they hold my H1 and 485 is pending for more than 6 months. i have valid EAD from pending 485.
I am getting full time opportunity, my new employer is ready to transfer H1 as well as they are willing to accept me using EAD. so its entirely my preference.
can you please tell me adv/dis adv of using H1 over EAD or vice versa. (my 6 yrs of H1 will finish in another 6-7 months)
