Hello Sir/Madam,

I came to US on H1B visa and recently i switched my job.My previous employer (INDIAN Employer) is asking me to return original H1 petetion which they filed.

Can anyone please help me with below queries
1. Do i need Original petetion from previous employer for Green Card processing ?.
2 Should i return H1 petetion or not to my previous employer ?.
2. Is it legal requirement that i need to return original H1 petetion to previous employer who filed it ?.

I would really appreciate and thankful , if you clarify my doubts.

You can return top part of petition and keep lower part with you. Before giving back just make a noterized copy with you. just in case.

:mad:I have another query and thats is i have a a far related cousin and her husband is on l1 visa . now my query is what visa is she on and what visa is her daughter on who was born here few months bak . also how shud she apply for a passport for this kid . is this kid an american citizen and also how to go about passport for the kid and also is it required to apply for visa for the kid to travel to India . Another serious issue she is been illtreated by her husband and how should she report this matter to the local police here .

* She is on L2.

* The kid is an American citizen. you can get a passport done at your local post office. Kid needs either visa, or PIO card to travel to india.

* Ask her to call her local police station (or even 911) and report this to the police (unless he has been physically abusive, she can probably tell him the next time he misbehaves she'll go to the police. Explain that a police record could mean lots of problems for him, going all teh way from GC, to getting a future job etc. If he does not shape up or has been physically abusive, then have her contact the police.)

Dear Attorney,



My company is willing to sponsor me and I have a few questions regarding the occupation.

I have no professional degree but I have 7 years experience as a general manager. My boss spoke to one attorney who said that I can be in EB-3 skilled worker but he (the attorney) is going to put that at least 5 years experience is required. The company that I have been working for is an export/import Asian food company (65 employees; $100 million revenue) so my boss is not going to hire someone who has only 2 years experience. The attorney also wants to put that a foreign language (Korean) is required as I will be responsible for making orders from Korea.

On the other hand I went to a different lawyer who said that if I want to be in EB-3 skilled worker the 2 years experience is enough and if there will be a foreign language requirement, most likely my ETA9089 will be denied. Also, he mentioned that a GENERAL MANAGER requires at least a bachelor's degree (as stated in SWA OES).

I would appreciate your input.

Hi all,

I submitted an application via premium processing for EB-1a with USCIS at the Texas Premium Processing Centre last month (April 2007).

I received an RFE notification via letter after two weeks listing the requirement of further evidence against 3 out of the 8 criteria I submitted.

I can submit further evidence - but my question is this ... "Why have they not made mention of the other 5 criteria I submitted" ? Has this failed ? Do they not matter ?. I am quite concerned because they have not made any mention of my other criteria ? Does anyone have any advice.

You are good till the end of your original H1 regardless of the outcome of the extension... the catch is, you have to maintain H1 status.. meaning get paid, no benching etc.,

Did anyone get their 140 approved from Vermont?
My 140 and 485 were filed late July 07 in Nebrasks and I got notices stating the 485 was transferred to Texas and 140 was being processed in Vermont.
The Vermont processing time for 140s has been stagnant at April 2006 for a long time.
Wondering if anyone has any updates on this.

Hello,

I have a H1B visa stamped on my passport for Company A. This visa is valid till Nov 2008 and will need renewal after that.

I recently changed my company from Company A to Company B. They have filed for my H1B transfer.

Question 1] Will this new H1B for Company B be valid for 3 more years (Till Feb 2011) or will this visa have to be renewed in November 2008 (remember by visa stamp for Company A is valid till Nov 2008)?

Question 2] What if I want to travel to India this October (remember by visa stamp for Company A is valid till Nov 2008)?? Can I still travel on my old visa stamp or will I need to go to embassy again in India for a new stamp

The House yesterday agreed to the Senate bill and passed it yesterday which is likely to grant the State Department the flexibility to rehire retired and fully trained passport processors on a temporary basis to help existing processors manage the increased demand. I am writing this Blog entry from my conference of the American Immigration Lawyers Association in Washington DC. In this past few days Immigration lawyers from across the nation gathered here in DC to share ideas and discuss our Immigration laws and policy. On Thursday not so far from our conference, the President (maybe he planned it), discussed Immigration reform for the first time in months.

President Obama stepped back into the political minefield of immigration policy Thursday, arguing for big changes in what he called a "broken" immigration system. But he warned that no such changes are possible without some Republican support.

From months now, Latino activists have been pushing the president to make good on his promise to overhaul the nation's immigration system. Thursday, in a speech at American University here in DC, Mr. Obama took up the challenge.

The speech followed meetings earlier in the week with immigration activists and Latino lawmakers.

To those concerned with security along the southern border with Mexico, Mr. Obama said, he's already put more boots on the ground than ever before. But, he argued, border enforcement by itself will not stop the flow of illegal immigrants.

Immigration is back in the spotlight now thanks to a new Arizona law requiring police to question anyone they suspect of being in the country illegally. Mr. Obama says he understands the frustration that led to that law, but he thinks Arizona went too far. His speech helped to lay the groundwork for an expected legal challenge by the Justice Department.

These are exciting times for all of us at the Immigration Bar, and being here in Washington makes you feel like part of the debate. I promise to keep you updated as we hear from USCIS officials and other government representatives on upcoming changes and other issues.

hi,

i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.

(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?

(b) If the validity is 1 year, what is the process for extending the I94 validity?

Applied for AP/EAD/485 in July 07.....I know that I can invoke AC21 after 180 days and change jobs.....My question is ,

1. If I travel to India before the 180 days and use the AP when I return, is it like invoking AC21 before 180 days ?

2. what are the consequences of using AP within 180 days after filing for 485 ?

3. Is AP and AC21 related ? [brother, sister , cousin :) ]

U.S. Department of Homeland Security Secretary Janet Napolitano today traveled to Laredo, Texas to announce more than $47 million in fiscal year 2010 Operation Stonegarden grants for the Southwest border states. She also met with law enforcement leaders to discuss the Department�s efforts to support state, local and tribal law enforcement in protecting communities from cross-border threats. She said, "Over the past year and a half, this Administration has pursued a new border security strategy with an unprecedented sense of urgency, making historic investments in personnel, technology and infrastructure while combating transnational criminal organizations that smuggle weapons, cash and people across our shared border with Mexico.� She said that Operation Stonegarden is one part of our overall strategy to provide state, local and tribal law enforcement on the frontlines the resources they need to confront the complex and dynamic challenges that exist along our borders.

The fiscal year 2010 Operation Stonegarden grants�totaling $60 million nationally�support 15 border states and the Territory of Puerto Rico to enhance the capabilities of federal, state, local and tribal law enforcement agencies to secure U.S. borders and territories. Funds were allocated using CBP�s sector-specific border risk methodology based on threat, vulnerability, miles of border and border-specific law enforcement intelligence. Nearly 80 percent of the fiscal year 2010 funding will go to Arizona, California, New Mexico and Texas�up from 59 percent in 2008. Operation Stonegarden grants can be used to support law enforcement personnel, overtime, and other related costs to increase operational readiness.
