I changed my employer after 9 months of filing 485 using AC21 a year ago and my new employer has reduced my workdays to 3 days a week starting this month. Can I get a second job for 2 days a week with same job description and salary etc ?
The AC21 job must be same/similar along with permanent and full-time. Your labor should indicate hours/week for the job. Usually CIS considers job with > 35 hours per week as full time.

As per Spet 2009 visa bulletin, my PD will be current . I recently moved to LA due to Job change . If i do AC 21, do you think i will miss a oppurtunity of getting GC in spet since my PD is OCT 2004.
Please advise. Should i do AC21 now ? Or Should i do only on RFE?
Another question. I still have permanent address in chicago but moved to LA. Do i need to do AC11 form?

I am also waiting on the dates to open in December. The dates are not available on the internet as yet. I think they open the dates for 1 week every week .. so you can only book a month in advance.

I had the visit from USCIS officer few months back, she said that is it Random. She asked routine questions. In our company we have two titles a corporate title and a working title (one for industry and one for job) she was very understanding about that difference. She asked me for a salary slip, address for my HR and some routine questions for my job.
I did talk to my lawyer after that and she said that she has started hearing about that for our company and it is ok. It is nearly 3 months since then and I have not heard anything so I assume everything is ok.
Don't worry I was very unsetled to see the USCIS and it did take me few days to get over it, but everything should be ok.

Gurus,
I have labor pending from a State A, now my employer is asking me to move to State B. However, my employer is willing to keep alive, labor process from State A and is also ready to file new labor from State B. Question is if labor A gets approved and if I apply I-140 on that labor, do I have to reapply I-140 for labor B, once labor B gets approved or I can use the same I-140?
Help is appreciated.

My H1B was expired on DEC11,2009.My employer applied H1B extension in Oct 2009, i'm still waiting for Approval notice. since my I-94 expired on DEC11,2009. what is my status untill i get my H1b extension? will i be in leagal status until i get the H1 approval?
I have EAD with the same employer but not using.

The US Department of State has released the new Visa Bulletin (http://travel.state.gov/visa/frvi/bulletin/bulletin_4575.html) for October 2009. In family-based categories, there is very slight movement forward, but just by a few weeks or months in most categories. However, Family 1st Preference for Mexico moves forward by 17 months
Employment-based categories remain "Current" for all 1st preference applicants, and for 2nd preference from Mexico, China, and countries other than India and China.
The biggest change is that the bulletin once again lists priority dates for 3rd Preference and Other Workers. These categories have been "Unavailable" since the May 2009 bulletin. Unfortunately, the priority dates listed on the October bulletin are all at least a few weeks behind the dates listed the last time, in the April bulletin. This may be the Visa Office being conservative in its first allocation of numbers for the new fiscal year. Let's hope so, and hope that they move forward in the next few months.

Yes you have to fill out separate forms. I applied for my parents last october. One of them got it in 10 days and the other took more than a month. It is advisable to get the application in well ahead of your trip

processing rate for green card applications. The Ombudsman attributes the slow rate of adjudications to inaccurate statistics and inefficient USCIS management of its workload. well if there's a way for you to get your approved labor certification doc, or even the copy of the filed labor application; then definitely get it.
The labor app has the exact job description too. So if you do use portability (ac-21) it'll help to match it with the job specs of the new position.
